Is there an EU nexus: placing an AI system or GPAI model on the market / putting it into service in the Union, or is the output used in the Union?
Under Art. 2(1) AI Act, providers (Anbieter) and deployers (Betreiber) in third countries (e.g. Switzerland) can also be covered — especially with market access into the EU or when the system's output is used in the Union. Purely Swiss use without EU output typically remains outside.
